1. Acceptance of these Terms

These Terms of Service ("Terms") are an agreement between you and biekdafreak ("we," "us," "the platform") governing your use of biekdafreak.com and its related services. By accessing or using the platform, creating an account, or submitting content, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the platform.

2. Eligibility

• You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to access or use the platform in any way.
• You must not be barred from using the platform under any applicable law.
• By using the platform you represent that all registration and verification information you provide is truthful and accurate.

3. Accounts

• You are responsible for your account, your login credentials, and all activity under your account.
• You may use a stage or scene name publicly, but information you provide to us directly must be accurate.
• We may suspend or terminate accounts that violate these Terms, applicable law, or the safety of the community.

4. Acceptable use

You agree NOT to use the platform to:

• post, request, or share any content involving minors, or sexualize minors in any way — this results in immediate termination and report to authorities;
• post content depicting or promoting non-consensual acts, or share intimate images of any person without their consent;
• harass, stalk, threaten, dox, or "out" any person, or disclose another person's private information without consent;
• engage in or facilitate illegal activity, including solicitation that is unlawful in the relevant jurisdiction;
• impersonate any person, business, or venue, or claim a listing you are not authorized to manage;
• spam, scam, defraud, distribute malware, scrape the platform, or interfere with its operation;
• upload content that infringes someone else's copyright, trademark, or other rights.

5. Your content

• You keep ownership of content you post. By posting, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content on the platform for the purpose of operating and promoting the platform.
• You are solely responsible for your content and must have all necessary rights and consents (including documented consent of any person appearing in it) before posting.
• We may remove any content at our discretion, including content that violates these Terms or that we receive valid complaints about.

6. Listings, events, and directory information

• Venue, event, service, and people listings are provided for general information. They are gathered from public sources and community submissions, are not guaranteed to be accurate or current, and may change without notice. Always verify details (hours, ages, policies, dates) directly with the venue or organizer before making plans.
• Business owners may claim a listing; we verify claims before granting management access, and we may revoke management access at any time.
• Reviews and submissions must be truthful, first-hand, and must not contain unverified allegations presented as fact.

7. Safety and education content

Educational material on the platform (including the Learn library) is general information only. It is not medical, legal, or professional advice, and it is not a substitute for in-person training from qualified instructors. You are responsible for your own choices and safety.

8. Third-party links and services

The platform links to third-party websites, venues, ticket sellers, and services we do not control. We are not responsible for their content, policies, or conduct. Transactions and interactions you enter into with third parties (including bookings between members) are solely between you and them.

9. Disclaimers

The platform is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not vet, endorse, or guarantee any member, venue, event, performer, or service listed on the platform.

10. Limitation of liability

To the maximum extent permitted by law, biekdafreak and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the platform, or from any interaction, event, or transaction with other members or third parties. Our total liability for any claim relating to the platform will not exceed the greater of $100 or the amount you paid us in the 12 months before the claim.

11. Indemnification

You agree to indemnify and hold harmless biekdafreak and its operators from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the platform, or your violation of these Terms or of any law or third-party right.

12. Termination

You may stop using the platform at any time. We may suspend or terminate your access at any time, with or without notice, for conduct that violates these Terms or harms the platform or its community. Sections 5, 9, 10, 11, and 13 survive termination.

13. Governing law

These Terms are governed by the laws of the State of Missouri, USA, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Missouri, and you consent to their jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the current version. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
